These Terms of Service govern your use of Gamojo.com, games developed or published by Gamojo, LLC that link to these terms, and related services (the “Services”). Gamojo, LLC is operated in Idaho, United States (“Gamojo,” “we,” “us,” or “our”). Contact: info@gamojo.com.
By accessing or using the Services, you agree to these terms. If you do not agree, do not use the Services. Additional terms presented for a particular game, promotion, or purchase apply to that offering. Our Privacy Policy explains how we handle personal information.
Privacy choices & statutory rights
Agreement to these Terms is not consent to optional advertising, analytics, or other tracking. Where required, consent must be requested separately and may be withdrawn. A parent’s agreement to these Terms does not replace any separate parental authorization required by data protection law.
Nothing in these Terms, including the liability provisions or choice of Idaho law, waives or restricts mandatory data protection rights, rights to complain to a supervisory authority, or remedies available under applicable law. See our information for EEA players and privacy request form.
Age & accounts
The Services are intended for users aged 13 or older. If you are below the age of legal adulthood where you live, you must have permission from a parent or legal guardian who agrees to these terms. You must also meet any higher age requirement shown for a particular game or required by law.
Where accounts are available, provide accurate information, keep your credentials secure, and promptly report unauthorized access. You are responsible for activity you authorize through your account. Do not impersonate others or access someone else’s account without permission.
Your license to play
Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial entertainment. Gamojo and its licensors retain ownership of the games, software, artwork, music, trademarks, and other content, except for content you own.
You may not copy, sell, redistribute, or exploit our Services or assets without permission, or reverse engineer the Services except where applicable law permits it.
Fair play
Do not use the Services to break the law; cheat or exploit bugs; distribute malware; interfere with servers; bypass security or payment systems; access data without authorization; infringe others’ rights; harass or threaten people; or submit unlawful or abusive content. Report security issues privately through our contact page.
If you submit feedback or support materials, you retain ownership and allow us to use them as reasonably necessary to respond, investigate issues, and improve the Services. Do not submit material you do not have the right to share.
Purchases & virtual items
Some games offer paid content, virtual currency, or virtual items. Prices, applicable taxes, and purchase conditions are displayed at checkout. You must have authorization to use the payment method. Purchases made through an app store are also subject to that store’s terms and payment rules.
Virtual items are licensed for use within the relevant game, have no cash value, and cannot be redeemed for money or transferred outside features we expressly provide. Their availability may change as a game evolves, subject to applicable law and any commitments made at purchase.
Refund eligibility is governed by applicable law and the relevant store or payment provider’s rules. These terms do not remove mandatory refund or consumer rights. Contact the store that processed your purchase for store-billed refund requests, or contact us if you need help identifying the transaction.
Subscriptions
Where offered, subscriptions may renew automatically for the period and price disclosed before purchase unless canceled according to the store’s instructions. Trial length, renewal pricing, and other offer-specific conditions are shown at signup. We or the store will provide notice of price changes where required.
Manage or cancel subscriptions through the store or service where you subscribed. Uninstalling a game or deleting a Gamojo account does not cancel a store subscription. Access after cancellation and any refund depend on the disclosed offer, applicable law, and store rules.
Ads, cloud saves & other services
Some games display advertising or link to third-party services. Third parties are responsible for their offerings, and their terms may apply. We do not guarantee third-party content or availability.
Online features require compatible devices and a network connection. Cloud saves and synchronization can be affected by outages, account changes, device settings, or technical issues. We cannot guarantee uninterrupted access or recovery of every lost save. Contact support if your progress is missing.
Changes, suspension & termination
We may update, modify, or discontinue features or Services. We may restrict or suspend access for violations of these terms, security risks, or legal requirements. Where reasonably practicable, we will provide notice and an opportunity to resolve an issue, except where immediate action is necessary.
You can stop using the Services at any time and request account deletion through our contact page. Any action affecting paid services remains subject to applicable consumer law and purchase commitments.
Disclaimers & responsibility
To the extent permitted by law, the Services are provided “as is” and “as available,” without warranties of uninterrupted or error-free operation or implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the extent permitted by law, Gamojo is not liable for indirect, incidental, special, or consequential losses arising from use of the Services, including lost profits or lost data. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including applicable liability for fraud, intentional misconduct, gross negligence, or death or personal injury caused by negligence. Your mandatory consumer rights remain in effect.
Governing law & disputes
These terms are governed by Idaho law, without regard to conflict-of-law rules, except that mandatory protections under the laws of your place of residence continue to apply. Courts in Idaho have non-exclusive jurisdiction, without limiting your right to bring a claim in another court available to you under applicable law.
Please contact info@gamojo.com about a dispute so we can try to resolve it. This does not prevent you from seeking available legal remedies.
Updates & general provisions
We may revise these terms and will update the date at the top of this page. We will give additional notice of material changes and seek agreement where required. If you do not agree to revised terms, stop using the affected Services.
If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver of it. Provisions that by their nature should survive termination will do so.
